CANTON, Miss. (AP) _ Attorneys for convicted murderer Carla Hughes say the jury may have held it against the former teacher for not testifying in her own defense.
Hughes’ attorney said in an appeals motion that, if the jury considered Hughes’ decision not to take the stand, the panel’s actions were a violation of jury instructions and his client’s constitutional rights.
Hughes was convicted last month on two counts of capital murder in the Nov. 29, 2006, killings of 27-year-old Avis Banks and her unborn child.
Prosecutors say Hughes killed Banks so she could have Banks’ fiance, Keyon Pittman.
Madison County District Attorney Michael Guest told The Clarion-Ledger he doesn’t believe there will be anything to overturn the case.
