BILOXI, Mississippi (AP) — The state Court of Appeals has upheld the capital murder conviction of Jeremy William Radau for the 2009 fatal beating of a 74-year-old Harrison County man.
Radau was convicted in 2013 and sentenced to life without parole.
Prosecutors say Charles E. Pickell was beaten to death with a baseball bat at his apartment on Sept. 19, 2009. Prosecutors say robbery was the motive.
Radau was arrested with his girlfriend, Megan Laurence Kinberger. Kinberger pleaded guilty to manslaughter, robbery and burglary. She is serving a 40-year-prison term.
Radau admitted killing the elderly man but argued prosecutors didn’t prove robbery, which elevated the crime to capital murder.
The Appeals Court says Kinberger testified robbery was the motive and authorities recovered the stolen cash and the baseball bat Radau took from Pickell’s apartment.
