OXFORD – (AP) The lawyer for a convicted sex offender says the man will pursue an insanity defense against a charge of failing to register.

A filing Thursday said Cleve Calloway Gordon has a mental disease that prevented him to know right from wrong at the time of the alleged offense, when he didn’t register from February to April.

U.S. District Judge Neal Biggers in Oxford recently ordered a mental the exam for Gordon. Biggers said the evaluation will be used to determine if Gordon is competent to stand trial or was legally insane at the time of the alleged offense.

Gordon, 26, was convicted of sexual battery in 2004. The indictment in the latest case says he failed to update his sex offender registration in Mississippi and didn’t register in Arkansas.
