Judge won’t throw out evidence in pain pill probe

A federal judge has refused to throw out evidence found in a south Mississippi casino hotel room as part of a prescription pain pill investigation.

Attorney Joe Holloman asked U.S. District Judge Sul Ozerden to suppress evidence gathered when police arrested Gail Owens and Charles MacGeorge at the Hard Rock Casino in Biloxi on Dec. 1, 2010.

Court records say police were working with information from an informant when they found more than 374 pain pills in the room, including oxycodone.

Holloman argued the search was improper.

Ozerden ruled last week that the search was legal and will allow the evidence.

Trial is set for May 14. MacGeorge and Owens have pleaded not guilty.

Holloman didn’t immediately respond to a message Sunday
