HATTIESBURG, Miss. (AP) – Hattiesburg pastor Kenneth Fairley, who was convicted of federal theft and conspiracy charges, is asking for a continuance for his sentencing.
Media outlets report that Fairley’s attorneys filed a motion that seeks a delay from Dec. 19 until January to allow time for the court to address Fairley’s objections to some items in his presentence report.
The motion also requests a sentencing hearing to address a probation officer’s rejection of Fairley’s claims in an addendum to the presentence report. Presentence reports aren’t available to the public.
Furthermore, the attorneys say they need time to bring in an expert appraiser to offer testimony as to the fair market value of the property involved.
Fairley was convicted Sept. 15 on three counts of conspiracy and theft in a federal case involving money skimmed from a federal housing program.
